In the spirit of transparency, we want you to know that...

You don't need an attorney to create an LLC. Many of you are badass entrepreneurs, running your business on a limited budget, and need to save $$$ wherever possible.

The purpose of this blog is to provide you with information on how you can create an LLC on your own #DIY.

Step #1: Check out the different types of business entities.

An LLC isn't your only option.

Step #2: Read a step by step guide on how to for form an LLC in Indiana.

This site will walk you through the entire process.

Step #3: Search your business name and products for active trademarks.

This search is different than the Indiana business name search explained in Step #2.

Many attorneys will charge you a fee to run this search. We think that is silly.

You can run a trademark search on your own here.

(This is the step everyone skips that causes big problems later).

You don't want to go through the hassle of creating an LLC and later learn that your business name or product name has an active trademark. This puts you at risk of receiving a Cease and Desist letter, having to hire an attorney, having to change your name, and having to re-brand/market your business. YIKES.

If you run into trademark questions or concerns, contact a licensed attorney in your jurisdiction. You can contact Daly Law LLC here.

Step #4: File your LLC.

Note: You will need to create an account with Access Indiana before you can file.

If you are the sole owner of your business, you may want to consider filing as a single member LLC. There isn't a separate application for this type of entity. Instead, you will select this option on the LLC application. To learn more about the benefits of filing as a single-member LLC, schedule a free consultation.

Step #5: File for an Employer Identification Number (EIN).

An EIN number can be used to open a business bank account and for hiring contractors or employees.

Note: You have to complete this application in one sitting. You can't save it and return to it later.

Step #6: Breath a sigh of relief.

It feels good to finally check off this task!
